Meaning of Discrimination -

Discrimination against women in the present context, means any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment or excise by women, irrespective of their marital status, or a basis of equality of men and women, of human rights and fundamental freedom in the political, economic, social, cultural, civil or any other field. Thus, to exclude or restrict a woman, on the basis of her sex excerising her human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field, amounts discrimination against her. On the question of Nationality of married women, it has been laid down under the convention on the Elimination of all forms of Discrimination against women that the states parties shall grant women equal rights with men to acquire, change or retain their nationality. It shall be the duty of the state parties to ensure that neither marriage with an alien nor change of nationality by the husband during marriages shall automatically change the nationality of the wife. She can neither be rendered stateless nor can be forced to adopt the nationality of her husband. The right of women to acquire, change or retain the nationality is not dependent upon the nationality of the husband, it is an obligation of states parties to ensure women to acquire, change or retain their nationality according to their choice. Women can neither rendered stateless nor the nationality of husband can be imposed upon them in the event they marry an alien or the husband changes his nationality. The convention on the nationality of married women also makes similar provisions. With respect to the nationality of children and the women will have equal right with men .


Other areas in which discrimination and inequality perpetuates against women - 

Apart from the question of political participation and desicion making, women suffer on account of discrimination and inequality in the following areas-

  1. Nationality of married women. 

  2. Property rights to married women.

  3. Right of married women to engage independent work. 

  4.  Parental rights and duties including guardianship.

  5. Domicile of married women. 

  6. Inheritance law as they affect women. 

  7. The status of unmarried women

  8. Legal capacity of married women.

  9. Discrimination against women in the administration of penal law and 

  10. Consent to marriage, minimum age of marriage and registration of marriage.

In order to eliminate discrimination against women in the above areas provisions are made in the convention on nationality of married women, the convention on consent to marriage, minimum Age for marriage and registration of marriage. The convention on the Elimination of all Forms of Discrimination against women and also in the declaration on the elimination of Discrimination against women.
